Jury Awards Victim of Deadly Arkansas Truck Crash $7 Million
Kentucky-based trucking company Dunaway Timber Co. has been ordered to pay $7 million in damages stemming from a fatal 2008 tractor trailer crash in Yellville. A U.S. District Court jury in Harrison, Arkansas, found that Dunaway Timber was 75 percent responsible for the fatal truck crash which occurred on U.S. 62 and Arkansas 202 on September 3, 2008. The driver of the Dunaway Timber tractor trailer, Morgan Quisenberry, was found to be 25 percent at fault. On the day of the fatal crash Quisenberry was at the end of a sleep deprived 24-hour shift when he lost control of his tractor trailer and collided with two passenger cars and the cab of another tractor trailer. The tractor trailer cab caught fire, trapping driver Roger Reagan inside. Reagan later died of a heart attack before reaching a nearby hospital. Quisenberry had been driving for 14 hours straight, a violation of the 11-hour commercial truck driving limit. Dunaway Timber was found guilty of sending him on the long route, knowing that it would not be completed within the legal limit for hours behind the wheel of a commercial truck. Additionally, the company negligently hired Quisenberry, failing to recognize that the driver had recently had an accident while driving hazardous materials and twice had his license taken away for driving intoxicated.

Train Horn Sounded Four Times Before Crash With Truck
Officials from the National Transportation Safety Board (NTSB) have revisited the Nevada crash site where tractor trailer driver Lawrence Valli crashed his rig into an Amtrak train on June 24, 2011, killing himself and four people on the train. NTSB officials arrived last week to reenact the chain of events that led to the fatal crash, putting a tractor trailer identical to the one that crashed through a variety of tests. Investigators skidded the tractor trailer and tested the brakes. They also conducted a test to see if the tractor trailer driver could hear the Amtrak train as it was approaching the railroad crossing. The engineer on the June 24 Amtrak train told investigators he blew his horn four times attempting to warn the driver of the railroad crossing. NTSB officials declined to reveal whether the train's horn could be heard from the tractor trailer cab.
Immediately after the crash, Amtrak and Union Pacific filed suit against John Davis Trucking, the company that employed Valli. John Davis Trucking immediately counter-sued. There are currently seven pending lawsuits against Amtrak and the John Davis Trucking Company in state court, seeking thousands in damages based on claims of negligence.

The lawsuit was filed in U.S. District Court for the Middle District of Pennsylvania listing as defendants, truck driver Dennis Ness, Eagle Systems, Inc. and Thoroughbred Direct Intermodal Services. The owner of the truck and trailer involved in the crash, Twist Trucking, LLC, and Swift Transportation Company, respectively, were also named as defendants in the lawsuit. "My client wants justice. Truckers need to be extra vigilant because of the greater damage they can cause in an accident and trucking companies should adopt better systems to prevent driver fatigue," said the family's trucking accident attorney, Cara Luther, of Baum Hedlund's Washington, D.C. office. Tractor Trailer Driver Convicted of Manslaughter in California Crash
Truck driver Marcos Costa was convicted of two counts of involuntary manslaughter, two counts of vehicular manslaughter and reckless driving in a crash that killed a man and his 12 year old daughter on April 1, 2009. Costa was also found guilty of injuring three other people in the La Canada Flintridge, California crash. Six vehicles and the tractor trailer were involved in the crash which concluded with Costa slamming into a bookstore and nail salon at Angeles Crest Highway and Foothill Boulevard. Witnesses of the crash say that Costa ignored the warning from an off-duty firefighter who informed the truck driver that smoke was coming out of his brakes. The firefighter also mentioned to Costa that the road was difficult going downhill. The intersection where the fatal crash occurred has produced similar crashes in the past. In the aftermath of the fatal crash, Caltrans put a 90-day ban on five-axle trucks traveling on Angeles Crest Highway between the Angeles Forest Highway and Interstate 210. National Road Safety in Jeopardy as ATA Lobbies for Weight Increase on Trucks
In mid June, the U.S. House Transportation and Infrastructure Committee is expected to address a “must pass” surface transportation spending bill. The American Trucking Association is using lobbyists and special interest groups to get legislation into this bill that would increase truck weight limits to 100,000 lbs. in every state - a 25% weight increase over the current 80,000 lbs. federal weight limit. Shippers like Kraft Foods are also using lobbyists and special interest groups to allow the weight increase. The Safe Highways and Infrastructure Protection Act (H.R. 1574/S.876), or SHIPA, has been introduced in the United States Senate and House of Representatives to put a "freeze" on current truck weight and length standards in place in every state. The legislation is very similar to legislation passed in 1995 that stopped trucking companies from utilizing triple trailer trucks that take the distance of a football field to stop. Heavier trucks with bigger payloads would increase the risk of fatalities and injuries resulting from tractor trailer/passenger car collisions, as well as increased pollution and more damage to the nation's deteriorating roads and bridges.
